5. Health Disclaimer & Assumption of Risk

By purchasing or using our products and digital plans, you acknowledge and agree that:

• Exercise carries inherent risks, including but not limited to muscle strain, injury, illness, or adverse health events.

• You voluntarily assume full responsibility for your participation in any fitness activities.

• You are responsible for assessing your own physical and mental readiness before use.

You agree to:

• Inspect all equipment before use

• Use equipment on appropriate, stable surfaces

• Follow provided guidance carefully

• Stop immediately if experiencing pain, dizziness, discomfort or distress

Nova Gym Box is not liable for injuries or health issues arising from:

• Improper use of equipment

• Failure to follow instructions

• Failure to seek medical advice

• Pre-existing conditions

• Overexertion or misuse

Nothing in these Terms excludes liability for death or personal injury caused by our negligence.

6. Orders and Contract Formation

All orders are subject to acceptance and availability.

A legally binding contract is formed only when we confirm dispatch of your order.

We reserve the right to:

• Refuse or cancel orders

• Cancel orders suspected of fraud

• Correct pricing errors

7. Pricing and Payment

• Prices are displayed in GBP and include VAT unless stated otherwise.

• Payment must be made in full before dispatch.

• We reserve the right to amend pricing at any time prior to order confirmation.

8. Shipping

Orders are dispatched within 48 hours (Monday–Friday, excluding bank holidays).

Delivery timeframes are estimates and not guaranteed.

We are not liable for courier delays outside our control.

9. Returns and Cooling-Off Period

Consumers have a 14-day right to cancel under the Consumer Contracts Regulations.

Customers are responsible for return shipping costs for non-faulty items.

Where goods are returned in a condition that reduces their resale value, we reserve the right to deduct an appropriate amount from the refund.

10. Digital Content (Workout & Nutrition Plans)

Nova Gym Box includes personalised digital workout and nutrition plans.

By purchasing and accessing your personalised plan, you:

• Request immediate access to digital content; and

• Acknowledge that once access has been granted, you lose your 14-day cancellation right in relation to that digital content.

If an order is cancelled after digital access has been provided, we reserve the right to deduct the value of the digital content (£39) from any refund issued.

Digital content is licensed for personal, non-commercial use only.

You may not copy, reproduce, distribute, modify, or resell any digital materials.

11. No Guarantee of Results

Individual fitness and nutrition outcomes vary.

Nova Gym Box makes no guarantees regarding:

• Weight loss

• Muscle gain

• Body composition changes

• Performance outcomes

Results depend on individual effort, adherence, health status, and lifestyle factors.

12. Limitation of Liability

To the fullest extent permitted by UK law:

• We shall not be liable for indirect, incidental or consequential loss.

• We are not liable for loss of income, loss of opportunity, or personal dissatisfaction.

• Our total liability for any claim shall not exceed the amount paid for the order in question.

Nothing in these Terms excludes liability for:

• Death or personal injury caused by negligence

• Fraud or fraudulent misrepresentation

• Any matter that cannot lawfully be excluded

13. Intellectual Property

All website content, systems, branding, digital plans, and materials are the intellectual property of Nova Gym Box.
